What is the Procurement Act 2023 and why?

The Procurement Act is a new law that creates a new and improved set of procurement regulations. The development of the Act was prompted by the UK leaving the EU in 2020 and intends to create a simpler, more flexible, commercial system that better meets the country’s needs, while remaining compliant with international obligations.

When does it ‘go live’?

In April 2024 the Cabinet Office's announced an intended “go-live” of Monday 28 October 2024.

HOW DOES IT IMPACT US

Remaining compliant; The new regulations will apply to all agreements created after the ‘go live’ date. The Public Contracts Regulations (PCR) 2015, will continue to apply to any agreements created prior to the ‘go live’ of the new regime.

Where does it apply for us?

The Act applies in full where the value of the procurement exceeds the threshold amount detailed in Schedule 1 of the Act. For works (construction) contracts the threshold is £5,336,937.
